P2 – Explain the impact of relevant legislatonnregulatons on any
two types of employment contract


Employment contracts in the UK are subject to a variety of legislatonn most of which has been
amended recently to improve the rights of the workersn from pay to equal opportunitess These
legislaton changes can come from oarliamentn through successful casesn as well as them being
created by the EUs
One such law which has improved the rights of workers is the 2010 Equality Actn which puts 4 major
EU Equal Treatment Directves into laws This law is enacted to all contractsn and helps to protect
people from discriminaton on a number of groundsn including racen sexn sexual orientatonn religion
as well as ages Due to the type of lawn this will cover all contractss
Another legislaton which protects workers in the UK is the 1998 Natonal Minimum Wage Acts This
helped workers by introducing a legal minimum pay for workers aged 16-17n 18-20n 21-24 and 25+s
Similarly to the Equality Actn the Natonal Minimum Wage Act will need to be adhered to by all
employers who use every contract types
Annual holiday is a statutory law in the UKn the minimum holiday a full tme worker is enttled to is
5s6 weeksn including bank and public holidays per years This is calculated pro-ratas Thereforen a part
tme worker working half of the tme which a full tme worker works will receive 14 days holidays
One issue in the UK with annual holiday being pro-rata is that due to zero-hours contracts having no
official hoursn some workers will not be enttled to any paid annual holidayn as this will class as a day
which they are not asked to come to works Statutory leaven however is limited to 28 daysn so workers
who works 7 days per week will not gain any additonal leave than a worker who works 5 days per
weeks
After a worker has been employed with a company for 6 monthsn they can apply for lexibilitys This
helps workers who have childrenn or those who have other commitments throughout the weeks An
employer must decide whether they wish to allow thisn or if they will reject this requests A valid
reason must be given for the rejecton leeers This can assist workers as if a worker has a child who
cannot gain childcare on a certain day untl middayn they will be able to work from middayn meaning
that the child is aeended throughout the days Howevern this cannot be agreed for all businessesn as
those which require certain hours to be worked will have to difers or examplen it is unlikely a full
tme teacher will be able to gain this beneit due to students being in class for a limited tmen and
them not being able to teach the students after the set inish tmes
This lexibility will afect full tme employment as it will enable the worker to complete their hours
during diferent tmes if they have other legitmate responsibilitesn and their job enables them to do
this during these amended hourss If the amendment is allowed to go aheadn this will give the
employee more lexibility in their works This may be simply changing the hours they workn for
examplen instead of startng work at 9am and inishing at 5pmn the worker may start work at 10am
and inish at 6pms If this was not possiblen the employee may also apply to change their contract to
reduce the total number of hours they works Due to thisn the employee may be able to change their
contract from full tme to part tmes oart tme workers can also apply to change aspects of their
contract through this lawn with them changing their hours of employmentn for example from 9am to
2pmn amended to 10am to 2:30pmn for examplen howevern they would not be able to increase their
total worked hoursn so unlike full tme employmentn they would not be able to change the type of
contract they are employed unders
