, Introduction
Construction refers to as an old, large, complex, and challenging business industry of the world
and the industry significantly contributed for the global urbanisation. Diverse and challenging
tasks are required to deal with the industry. Therefore, the challenge of dispute faced by the
industry which not only impacted projects within the industry, but also legal challenges are being
faced by the industry with the clients and other parties. Various disputes, including project
delays, budget overrun, contract ambiguities, and unforeseen circumstances are the major
disputes for the construction business which encountered legal challenges between the
organisations of the industry and clients Chappell, D. (2021).
Due to the influence of these disputes complexity is being encountered within to industry and to
ensure effective mitigation and management of these disputes gradually comprehensive and
productive legal frameworks developed and demonstrated by the legal system of diverse
countries. In the UK, comprehensive construction law is developed and leveraged which defined
diverse guidelines and policies. These regulations are significantly and strictly required to be
complied by the industry organisations in the process of agreement generation with the client,
complete the project, and handover the project so that disputes cannot be triggered. In addition,
effective laws are demonstrated by the UK so that smooth addressing of disputes can be
promoted and ensuring of diverse rights of organisations and clients can be ensured.
Construction law refers to as a robust framework of the UK which is being functioned so that
disputes can be avoided, and navigation of issues can be promoted smoothly if disputes are being
encountered Eggleston, B. (2019). Productive management and mitigation of the legal challenges
between the parties within the industry refers to as the primary aim of the UK construction law.
The case scenario of the study showcased that, a construction firm and a university are two
parties, and the firm is assigned the project of constructing residential for educators by the
university and the total budget of the project refers to as £22 million. Joint Contracts Tribunal
(JCT) refers to as an effective framework of contract which is agreed and demonstrated by both
the parties for the project agreement generation. An analysis on the contract revealed that 18
months were planned and agreed by the both the parties for the completion and handover of the
entire project. The client failed to address the deadline and contract term which create the
